These Terms of Service ("Terms") govern your access to and use of Puchi's smart home products, services, and website (collectively, the "Services") provided by Puchi Technologies ("Company", "we", "us", or "our").

By using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

By accessing or using our Services, you affirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Puchi provides smart home automation products and services, including but not limited to:

• Puchi Realtime Audio - Smart home audio and communication systems
• Puchi WhatsApp Conversations - Professional-grade audio solutions
• Puchi Smart Integrations - Home analytics and automation insights
• Mobile applications and web-based control interfaces
• Cloud-based data processing and storage services

To access certain features of our Services, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Promptly notifying us of any unauthorized use of your account
• Providing accurate and up-to-date account information

You agree not to use our Services to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our Services
• Upload or transmit malicious code
• Use our Services for any commercial purpose without authorization

ASSUMPTION OF RISK: By using our products, you acknowledge and assume all risks associated with electronic devices, smart home automation, and network-connected equipment.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

Our Services and all content, features, and functionality are owned by Puchi Technologiesand are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use our Services for personal, non-commercial purposes.

You retain ownership of any content you create or upload to our Services, but you grant us a license to use, store, and process such content as necessary to provide our Services.

Limited Hardware Warranty

Puchi Technologies provides a limited 1-year warranty on all Puchihardware products against manufacturing defects. This warranty:

• Covers manufacturing defects in materials and workmanship only
• REQUIRES mandatory product registration within 30 days of purchase
• Does not cover damage from misuse, accidents, normal wear, or unauthorized modifications
• May result in repair, replacement, or store credit at our sole discretion
• Is void if product serial numbers are removed, altered, or tampered with
• Excludes labor costs, shipping, or any consequential damages

Software and Service Disclaimers

EXCEPT FOR THE LIMITED HARDWARE WARRANTY ABOVE, OUR PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
• WARRANTIES OF NON-INFRINGEMENT
• WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE

We do not warrant that our Services will be uninterrupted, error-free, or completely secure. Software updates and cloud services may be discontinued at any time.

To the maximum extent permitted by law, Puchi Technologies shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, business interruption, or use, arising out of or relating to these Terms or our Services, regardless of the theory of liability.

Our total liability to you for all claims arising from or related to the Services shall not exceed the amount you paid us for the specific product or service that gave rise to the claim during the twelve (12) months preceding the claim.

To the maximum extent permitted by law, our liability for defective products is limited to:

• Repair or replacement of the defective product under warranty terms at our sole discretion
• Refund of the purchase price only if repair/replacement is deemed impossible by us
• Maximum liability never exceeding the original purchase price of the specific defective product
• No coverage for shipping, installation, or service costs

We shall not be liable for:

• Consequential or indirect damages including lost profits, business interruption, or lost opportunities
• Data loss, corruption, or breach resulting from product failure, software issues, or third-party access
• Personal injury, property damage, or economic losses unless directly caused by proven manufacturing defects
• Damages, costs, or expenses exceeding the original purchase price of the product
• Installation, removal, reinstallation, configuration, or professional service costs
• Compatibility issues with third-party devices, software, or services
• Network security breaches, unauthorized access, or privacy violations
• Power surges, electrical damage, or environmental conditions

You agree to indemnify, defend, and hold harmless Puchi Technologies, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use or misuse of our Services or products
• Your violation of these Terms or applicable laws
• Improper installation, modification, or repair of our products
• Any damage caused by electrical issues, power surges, or environmental factors
• Data breaches or security incidents related to your network or devices
• Any claims arising from your failure to follow safety warnings or instructions

This indemnification obligation will survive termination of these Terms and continues indefinitely.

We may terminate or suspend your access to our Services at any time, with or without cause or notice. You may also terminate your account at any time by contacting us. Upon termination, your right to use our Services will cease immediately, but all liability limitations and indemnification obligations will survive.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such changes constitutes acceptance of the new Terms.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. The courts of Hyderabad, Telangana, India shall have exclusive jurisdiction over any disputes arising from or related to these Terms or the use of our Services.

By using our Services, you irrevocably consent to the jurisdiction of the Indian courts and waive any objection to venue or inconvenient forum. You also agree that any legal action must be commenced within one (1) year of the cause of action arising, or such claim will be permanently barred.
